Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the LocSnaps mobile application (the "Service") operated by LocSnaps ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Acceptance of Terms

By creating an account and using LocSnaps, you agree to:

  • Comply with these Terms and Conditions
  • Comply with our Privacy Policy
  • Comply with all applicable laws and regulations in Jamaica and your jurisdiction
  • Be at least 13 years of age

2. Description of Service

LocSnaps is a hyperlocal community platform that enables users to:

  • Create and respond to location-based information requests
  • Share real-time local information through text, photos, and videos
  • Broadcast live status and availability to help nearby community members
  • Find essential services (hospitals, police, pharmacies, shelters)
  • Access and share community-generated disaster evacuation routes
  • Build credibility through helpful responses
  • Earn and offer credits to reward helpful community members
  • Purchase credits via in-app purchases (Apple Pay/Google Pay) or access additional requests via ads
  • Participate in gamification features: check-ins at public landmarks, quests, collections, and leaderboards
  • Earn rewards through daily activities and community engagement

3. User Accounts

3.1 Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

3.2 Account Requirements

  • One account per person
  • Accounts must use a valid phone number or email address
  • Display names must not impersonate others or contain offensive content

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time if:

  • You violate these Terms and Conditions
  • You engage in fraudulent, abusive, or illegal activities
  • You repeatedly post inappropriate or harmful content
  • Your account has been inactive for an extended period

4. User Conduct and Prohibited Activities

4.1 You agree NOT to:

  • Post false, misleading, or deceptive information
  • Harass, threaten, or abuse other users
  • Post content that is illegal, obscene, offensive, or violates others' rights
  • Share personal information of others without consent
  • Use the Service for commercial advertising or spam
  • Attempt to manipulate credibility scores or voting systems
  • Impersonate others or misrepresent your identity
  • Use automated systems or bots to interact with the Service
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Engage in credit fraud, chargebacks, or payment manipulation
  • Create multiple accounts to abuse free tier limits
  • Spoof your location or use emulators/simulators to fake check-ins
  • Manipulate gamification systems (quests, leaderboards, collections)

4.2 Content Guidelines

All content you post must:

  • Be relevant to the request or topic
  • Be respectful and appropriate for all audiences
  • Not contain personal attacks or hate speech
  • Not promote violence, illegal activities, or dangerous behavior
  • Comply with copyright and intellectual property laws

5. Live Status Broadcasting

When using the Live Status Broadcasting feature:

  • You consent to sharing your real-time location with nearby users
  • You control the visibility radius and duration of your broadcast
  • You can stop broadcasting at any time
  • You are responsible for your safety and privacy while broadcasting
  • You must not use broadcasting to engage in illegal activities
  • You understand that users within your visibility radius can see your exact location

Safety Warning:

Only broadcast your live status when you are comfortable sharing your real-time location. Do not broadcast in dangerous situations or areas where your safety may be compromised.

6. Disaster Routes Disclaimer

IMPORTANT DISCLAIMER:

LocSnaps is NOT affiliated with, endorsed by, or representing any government entity or emergency management agency in Jamaica or elsewhere.

All disaster route information, evacuation routes, and emergency-related content in this app is community-generated and unverified by authorities. This information has NOT been endorsed or verified by government agencies.

6.1 Your Responsibility

  • Verify Information: Always consult official sources for disaster preparedness and emergency information
  • Official Resources: Contact the Office of Disaster Preparedness and Emergency Management (ODPEM) at www.odpem.org.jm or call 1-888-DISASTER (347-2783)
  • Follow Official Guidance: Official government evacuation orders and warnings take precedence over any information in this app
  • Use at Your Own Risk: You assume all risks associated with relying on community-shared disaster routes

6.2 No Emergency Service

LocSnaps is NOT an emergency service. In case of emergency:

  • Call 119 (Jamaica Emergency Services)
  • Call 110 (Police)
  • Call 116 (Fire Department)
  • Contact ODPEM at 1-888-DISASTER (347-2783)

7. Gamification & Check-Ins

7.1 Check-Ins at Public Landmarks

  • Check-ins are available at curated public landmarks (beaches, attractions, restaurants)
  • You must be physically present within 200 meters of the landmark to check in
  • Device attestation via Firebase App Check verifies your device is genuine
  • Location spoofing, emulators, or simulators are prohibited and will result in account suspension
  • Check-ins earn you credits and contribute to quests and collections

7.2 Quests & Collections

  • Quests are challenges that reward you for completing activities
  • Collection cards are earned through check-ins and quest completions
  • Leaderboards display rankings based on community contributions
  • Quest rewards and collection cards have no cash value outside the app

7.3 Daily Activities

  • Daily fun facts and streak tracking encourage regular engagement
  • Daily rewards are subject to change without notice
  • Abuse of daily reward systems will result in disqualification

Anti-Cheating:

We use Firebase App Check to verify device authenticity. Users who spoof locations or use modified apps will be permanently banned and forfeit all credits and rewards.

8. Wallet, Credits & Payments

8.1 Credit System

  • Credits are the in-app currency used to reward helpful responses and gamification achievements
  • You earn credits when your responses are marked as helpful by requesters
  • You earn credits through quests, check-ins, and daily activities
  • You can offer credits to incentivize quick responses to your requests
  • Credits have a monetary value: 1 credit = $0.10 USD

8.2 Purchasing Credits (In-App Purchases)

  • Credits are purchased via Apple App Store or Google Play Store
  • Payments are processed by Apple Pay or Google Pay through RevenueCat
  • Available packages:
    • Starter: 75 credits for $5 USD
    • Basic: 170 credits (includes 10% bonus) for $10 USD
    • Popular: 375 credits (includes 20% bonus) for $20 USD
    • Value Pack: 1000 credits (includes 30% bonus) for $50 USD
  • Platform Fees: Apple and Google charge platform fees (typically 15-30%) on all in-app purchases. Your wallet balance reflects the credit value after these platform fees are applied
  • Purchased credits are non-refundable except as required by Apple/Google refund policies
  • You must be at least 18 years old (or have parental consent) to purchase credits

8.3 Withdrawing Credits

  • Minimum withdrawal: $5 USD (50 credits)
  • Withdrawals processed via bank transfer within 3-5 business days
  • You must provide valid bank account details
  • We reserve the right to verify withdrawals and prevent fraud
  • Suspicious activity may result in account suspension and forfeiture of credits

8.4 Credit Rewards on Requests

  • You can optionally offer credits to responders as incentive
  • Offered credits are held in escrow until you mark a response as helpful
  • If no response is marked helpful within 24 hours, credits return to your wallet
  • Offering ≥25 credits makes the request FREE (bypasses daily limits)

Fraud Prevention:

We monitor all credit transactions. Fraudulent activity, including chargeback abuse, will result in immediate account termination and forfeiture of all credits.

9. Free Tier, Ads & Access Limits

9.1 Free Tier

  • You receive 5 free requests per day
  • Unlimited responses are always free
  • Free request counter resets daily at midnight UTC
  • Offering ≥25 credits on a request bypasses the daily limit (free post)

9.2 Ad-Supported Access

  • After exhausting free requests, you can watch a 30-second rewarded ad
  • Each ad watched grants 1 additional request
  • Ads are served via Google AdMob (subject to Google's Terms)
  • Alternative: Spend 10 credits instead of watching ads

9.3 Your Agreement

  • You agree to the daily request limits and ad-supported model
  • You will not use multiple accounts to circumvent limits
  • You will not manipulate or abuse the credit exemption system
  • We reserve the right to modify limits and pricing with notice

10. App Updates & Version Management

By using LocSnaps, you agree that:

  • We may require you to update to the latest version for security or compatibility
  • Critical updates may block app access until you update
  • We track app versions to ensure platform security
  • Updates are delivered through official app stores (Google Play, Apple App Store)
  • You are responsible for keeping your app updated

11. Content Ownership and License

11.1 Your Content

  • You retain ownership of all content you post to LocSnaps
  • By posting content, you grant LocSnaps a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the Service
  • You represent that you have the right to post all content you submit
  • You are responsible for obtaining any necessary permissions for content you post

11.2 Our Content

  • LocSnaps and its original content, features, and functionality are owned by LocSnaps and are protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, or create derivative works of our Service without permission

12. Privacy and Data Processing

Your use of LocSnaps is also governed by our Privacy Policy. By using the Service, you agree to our collection and use of information as described in the Privacy Policy, including:

  • Processing of your location data for location-based features
  • Automatic face blurring in uploaded media
  • Display of your public information (display name, responses) to other users
  • When broadcasting live: Sharing your real-time location within your chosen visibility radius
  • Device attestation via Firebase App Check for check-in verification
  • In-app purchase processing through Apple App Store or Google Play Store
  • Gamification tracking including check-ins, quests, collections, and leaderboards

13. Intellectual Property

  • You must not post content that infringes on others' intellectual property rights
  • We respect intellectual property rights and expect users to do the same
  • If you believe content on LocSnaps infringes your copyright, contact us immediately

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • LocSnaps is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee the accuracy, reliability, or availability of the Service
  • We are not responsible for user-generated content or actions taken based on information in the app
  • We are not liable for any damages arising from your use of the Service
  • We are not responsible for community-shared disaster routes or emergency information
  • You use the Service at your own risk

14.1 Specific Disclaimers

Disaster Routes: We expressly disclaim all liability for any injury, loss, or damage arising from reliance on community-generated disaster routes or emergency information. Always follow official government guidance.

Essential Services Information: While we strive to provide accurate location information for essential services, we do not guarantee the accuracy or completeness of this information. Always verify service availability and hours directly.

User Safety: We are not responsible for any physical harm, injury, or loss that may occur from in-person meetings or interactions arranged through the Service.

In-App Purchases: We are not responsible for failed purchases due to payment processor issues. Refund requests for in-app purchases must be submitted to Apple or Google according to their refund policies.

Gamification Rewards: Quest rewards, collection cards, and leaderboard rankings have no guaranteed value and may be modified or removed at our discretion.

15. Indemnification

You agree to indemnify and hold harmless LocSnaps, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Content you post to the Service

16. Credibility System

  • Your credibility score is calculated based on helpful responses and community ratings
  • We reserve the right to adjust credibility scores to prevent manipulation
  • Credibility scores are not transferable or redeemable for monetary value
  • We may reset or adjust scores if we detect fraudulent activity

17. Modifications to Service

We reserve the right to:

  • Modify or discontinue the Service at any time without notice
  • Change features, functionality, or availability of the Service
  • Impose limits on certain features or restrict access to parts of the Service

18. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the new Terms in the app
  • Updating the "Last Updated" date
  • Sending you a notification if changes are significant

Your continued use of the Service after changes constitutes acceptance of the updated Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Jamaica.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LocSnaps regarding the Service and supersede any prior agreements.
